In Florida, heirs must “administer” an estate (Probate) when someone passes away, with or without a Will or a Trust. A Will or Trust is essentially a set of instructions that follow the wishes of the decedent. It appoints someone (usually a loved one) to be in charge and follow through on those instructions. That someone is called either a Personal Representative, Executor or Trustee. They usually must follow those directions under the scrutiny of a Judge.
