The USCIS may have concern that you came to the US with immigrant intent since you already had an H1B filed on your behalf when you came on a B2....

If I understand your question correctly, you want to leave the US and apply another time. Have your employer withdraw the application and leave.

I agree. The 2012 tax return is not due yet, so the sponsor should use the 2011return and proof of current income.
