As long as he makes the payment, it shouldn't be an issue. They almost never have a problem if you surrender your interest.

Yes, this is a very common reason for Bankruptcy as long as it wasn't a DUI.

You need to file the POC as everyone states. You may also ask for relief if there are other grounds to pursue the contempt order.

If the debt was before the BK. All you need to do is file a suggestion of bankruptcy in the case if they do sue you.

If you can file right away the whole thing takes about 95 days due to Holidays and people in at the Court being out.
