Time Served and terminate Supervised Release 18 mos early
Sep 11, 2014
OUTCOME: 30 days on Viol of Supervised Release and Terminate Supervision 18 months early
My client was transferred from NH to FL for supervised release after a sentence of 51 months in federal prison. He violated with a dirty urine. His original lawyer never brought to the court's attenti...on that he was struck by a delivery truck when he was two and suffered a fractured skull, LOC, migraine headaches and seizures. He struggled all through school and dropped out because he could not mentally do the work. His original sentencing judge was never made aware of these facts. He was sentenced to far too much time at such a young age. He did not benefit from the crack retro change in the law. He might be one Floridian who could legitimately get medical marijuana if it passes because it is the only thing that lessens his migraines.
My client was a 2nd tier cocaine distributor from San Andres Island, Colombia who was responsible for distribution of cocaine via boat to Honduras. The cocaine was ultimately destined, in part, to the... U.S. His federal guideline was 235 to 292 months. I was successful in getting 216 months without a government request for a sentence reduction just based on 3553(a) factors.
