In November 2010, Cardillo Law Firm reached a confidential settlement with Nationwide on behalf of Palma Vista Condominium in order to resolve its termite damage claim against Nationwide. The Associat ... ion spent approximately $1.2 million to complete termite repairs. Cardillo Law Firm achieved a significant ruling in the case which led to the settlement, which can be found at Palma Vista v. Nationwide, 2010 WL 4274747 (M.D. Fla. Oct. 7, 2010). Separate claims against Palma Vista’s insurance agency and against Terminix remain pending.

On or about May 17, 2007, Plaintiff, Kurtis Kelly, commenced this action in the Thirteenth Judicial Cir-cuit in and for Hillsborough County, Florida. Plaintiff alleges that Defendant, General Star Nati ... onal Insur-ance Co., breached its contract by failing to pay the coverage amount requested under the insurance claim. (Dkt.2, ¶ 22). On July 2, 2007, Defendant filed a Notice of Removal, wherein it alleges this Court has original diversity jurisdiction pursuant to 28 U.S.C. § 1332(a). (Dkt.1, ¶ 7). Specifically, Defen-dant asserts that (1) Plaintiff is a citizen of Florida, (2) Defendant is a business incorporated in the state of Ohio, with its principal place of business in Con-necticut, and (3) the amount in controversy exceeds $75,000. (Dkt.1, ¶ 7). Defendant calculated the amount in controversy by relying on the insurance policy limit, not on the amount pled by Plaintiff. (Dkt.1, ¶ 7). In the amended complaint, Plaintiff al-leges the “breach of contract damages ... exceed $15,000.” (Dkt.2, Comp.¶ 22). Plaintiff moves to remand this action back to state court. (Dkt.6), Plaintiff contends remand is proper because Defendant failed to establish by a preponder-ance of the evidence that the amount in controversy more likely than not exceeds the jurisdictional re-quirement of $75,000.

In September 2008, after 8 years of litigation, Orkin agreed to pay $848,000 to settle a criminal racketeering suit. The court had recently granted Sandalwood permission to seek punitive damages based ... on its false advertising claim against Orkin, and rather than face a jury trial scheduled for November, 2008 in Bushnell, Florida, the pest control giant was finally held accountable. The $848,500 payment is in addition to an earlier litigation settlement with Sandalwood's insurance company Allstate. In 2004, Allstate agreed to pay Sandalwood $2.25 million the day before a federal jury trial was set to begin in Tampa. Additionally, in 2007, Sandalwood reached a confidential settlement with its insurance agency in connection with the significant termite damage at the property. In total, Cardillo Law Firm achieved cash payments from various responsible parties totaling nearly $4 million. The Firm is very proud of this remarkable chain of results for this client, which was achieved only after grueling battles in 3 separate lawsuits.
