If they did not have all the paperwork together, some judges will dismiss and some won't. The safe bet is to think that the judge will not dismiss....

They don't have to name the HOA, that is up to the Plaintiff. But they probably should. They may change the complaint later and add the HOA

Generally, you cannot expunge or seal an adjudication of guilt. You MIGHT be able to get an attorney to help you change the adjudication from guilt...
