OUTCOME: Won. Mississippi Supreme Court held client's parental rights should not have been terminated.

It was first necessary to obtain a ruling from the U.S. Supreme Court stating that Mississippi had to provide a way for the mother to appeal the termination of her parental rights even though she could ... n't pay the appeal costs. Robert McDuff, a very fine attorney, argued in the USSCT. After winning there we were able to obtain a favorable ruling in the Mississippi Court of Appeals and the Mississippi Supreme Court.

OUTCOME: Won. MS Supreme Court ruled the instruction should have been allowed and reversed and remanded the conviction.

Appeal of conviction of felony simple assault on law enforcement officer. Lower court refused to allow jury instruction providing possibility of lesser-included charge of resisting arrest.

Herdahl v. Pontotoc County School District

OUTCOME: Won. District found to be clearly promoting a specific religious viewpoint.

First Amendment, Establishment Clause violations. School district was sponsoring daily sectarian prayer over the intercom (even testified at trial that other religions would not be permitted) and permi ... tting local churches to hire teacher for Bible class.

OUTCOME: Settlement. Work finished by another contractor and clients able to take a trip to Florida to visit daughter.

Home Improvement fraud. Arkansas siding company had clients sign deed of trust despite homeowners' statement they didn't want to "pawn" their house. Work incomplete, poorly done, property damaged until ... clients ran them off.
