On June 16, 2001, Plaintiff Joseph Staples was injured in a motorcycle accident. Plaintiff suffered serious injuries in that accident. He began employment with Caremark in December 2002 as a staff phar ... macist. He remained employed with Caremark until December 2006. Plaintiff alleges that when he first began employment at Caremark he was told he would be working a desk job. 3 Plaintiff testified that the impairments he suffered in his motorcycle accident were accommodated by Caremark by providing him a raised work desk. Plaintiff asserted He was denied overtime opportunities because of his disability. Summary Judgement was denied on that issue.

OUTCOME: The court affirmed the award of summary judgment in favor of appellees (Glenn Levy's Client)

Appellant employee was terminated from his position with appellees, employer and affiliates, because company profits decreased as a result of his employment. Appellant initiated an action for breach of ... contract, wrongful termination, breach of promise of job security, intentional infliction of emotional distress, fraud, and promissory estoppel. The lower court granted appellees' motion for summary judgment because it found that appellant was an at-will employee and could be terminated for any reason. Appellant sought review and the court affirmed the award of summary judgment in favor of appellees because it found that appellees had not modified appellant's at-will status to a specific contractual arrangement. Therefore, the court held that appellant could not recover for breach of contract, wrongful termination, and breach of promise of job security. The court held that appellant could not recover for intentional infliction of emotional distress because there was no evidence of outrageous conduct or harassment. Although appellant was not barred from bringing a cause of action for fraud, there were no specific promises upon which reliance was reasonably made.
