620, LLC v. Meridian, Inc.
Jul 17, 2017OUTCOME: Prevailed at the Washington State Court of Appeals
Seth prevailed in a case he argued in front of the Washington State Court of Appeals. In that case, Seth’s client brought breach of contract claims against a general contractor arising from that contr ... actor’s allegedly defective construction work. Before bringing those claims, Seth’s client executed a settlement agreement with the general contractor to resolve a dispute arising from the construction project. The trial court found that this settlement agreement’s release provision precluded breach of contract claims and dismissed his client’s lawsuit. But, Seth convinced the Court of Appeals that the trial court erred in dismissing his client’s case. The Court of Appeals agreed with Seth that the settlement agreement’s release provision could have reasonably preserved his client’s breach of contract claims, and the Court of Appeals ordered the trial court to send the case back to trial.
