Hanrahan was picked up for speeding 73 in a 70 on Interstate 80 in eastern Iowa as part of a drug interdiction investigation. Hanrahan's car was searched and over $50,000.00 in cash was seized. A mar ... ijuana joint was found. We aregued the search of his vehicle was unlawful under the 4th Amendment and Article 1 Section 8 of the Iowa Constitution. Hanrahan was convicted of possession of marijuana and his money was forfeited to the State. We then appealed and the Iowa Court of Appeals agreed that the search was unlawful, vacated the conviction and ordered the State to return Mr. Hanrahan's money!
OUTCOME: Evidence Suppressed, Case Dismissed.
Mr. Blemke was stopped for running a stop sign off of Interstate 35. The officer suspected that Mr. Blemke might be under the influence of a drug and proceeded to investigate.
