The Defendant was charged with possession of a firearm by a convicted felon, and possession of ammunition by a convicted felon. In Florida, there is a minimum mandatory 3 year prison sentence if convi ... cted of this crime. The facts of the case involved three males riding their bicycles in Fort Lauderdale in the evening. The three men were stopped by the police and commanded to turn over their belongings for search. The search allegedly produced a firearm that was loaded with ammunition. An interview of the police officer uncovered that he had no legal reason for stopping the three men. We were able to successfully argue that the stop was illegal, and have any evidence discovered as a result of the illegal stop, suppressed.
