A gas well operated by a client had been produced beyond the production allowable established by the Oklahoma Corporation Commission. The operator of adjacent gas wells sought an order of the Corporati ... on Commission shutting in the overproduced well, and the operator sought an order of the Corporation Commission retroactively establishing a separate production allowable for the well, effectively ratifying the overproduction. The Corporation Commission denied the application to shut the well in and granted the client's application for a separate allowable retroactively. Successfully defended the order of the Corporation Commission on appeal.

OUTCOME: Obtained summary judgment declaring town's annexation invalid and permanent injunction against enforcement of ordinance; affirmed on appeal.

An Oklahoma town attempted to enforce an ordinance against a landowner. Filed action for declaratory judgment and permanent injunction against the town preventing enforcement of the ordinance against ... the landowner. On motion for summary judgment, the court declared the town's annexation that included the landowner's property invalid and permanently enjoined the town from enforcing its ordinances against landowner on the basis that the town lacked jurisdiction. Successfully defended of the trial court on appeal.
