Mr. Gelinas was the first consumer in Florida to arbitrate his issues regarding his defective recreational vehicle (RV) under Florida's present RV Lemon Law program. Mr. Gelinas was successful in hav ... ing his RV declared a "lemon" and then sought to have his attorney fees for having to bring the lemon law case reimbursed from the manufacturer, Forest River. After over 8 years of court procedures, Florida's supreme court confirmed that Mr. Gelinas was in fact entitled to have his attorney's fees reimbursed by Forest River, the manufacturer of the defective RV.

OUTCOME: Patrick Cousins won case for Mr Fox

Landmark 2008 case where Mr. Fox won his lemon law claim against Porsche and was awarded nearly $600,000 in damages thus making it the largest lemon law victory in Florida and arguably the largest in ... America. Thereafter, Mr. Fox filed another action against Porsche to recover the attorney fees he paid to have his vehicle declared a lemon. Ultimately this case was appealed and I, Patrick Cousins, made the oral argument heard front of the United States Court of Appeals for the Eleventh Circuit which held that the case Gelinas V. Forest River (another one of my landmark cases) controlled thus allowing Mr. Fox to recover his attorney fees.

A fitting end to an auspicious beginning, Mr. Gelinas was the very first person to file a Lemon Law claim on a Recreational Vehicle in Florida. Mr. Gelinas won his Lemon Law arbitration but was not com ... pensated for the fees paid to his attorney or for other damages not covered under Florida’s Lemon Law program. Cousins Law Firm sued the Manufacturer to recover the damages not covered by the Lemon Law Arbitration Program, such as expenses for maintaining the vehicle that was deemed a lemon, and the fees Mr. Gelinas paid in fighting the Manufacturer over his lemon coach. After a lengthy court battle, where one court ruled completely opposite of another, Cousins Law Firm and Mr. Gelinas persisted and prevailed in winning the right to collect his damages.
