I was adj. guilty of criminal mischief (misd.) in 2005, and would like to change the adj. to a withhold. Is that possible?

At this late stage it is very unlikely that you would be successful in any attempt to vacate the plea. You need to consult with a post conviction...

What are we looking at for penalty's???? jail time? We've never been arrested before and never committed any other crime.

There is no rule. Each case is handled individually and completely up to the discretion of the state.
