OUTCOME: Held: payment of entry to owner of campground eliminated recreational use immunity (CC 846) as to all landowners. (10 Cal.App.5th 563)
Plaintiff was asleep in tent at campground when tree fell on him, causing catastrophic polytrauma injury. Public utility had a license to enter property to inspect trees near its power lines.
OUTCOME: Defendant restaurant's motion for summary judgment on the ground the driver was not in the course and scope of his employment denied.
Plaintiffs suffered multiple injuries when their vehicle was struck head-on by a drunk driver on a rural road. After finishing his shift as the general manger of the defendant restaurant, the driver we ... nt home and drank wine. He then went to a beach, and was returning home when the accident occurred. Plaintiffs contended the driver had drunk openly at work for many years and that his drinking at work on the day of the accident contributed substantially to the level of his intoxication at the time of the accident.
OUTCOME: County's motion for summary judgment denied.
Plaintiff was rendered quadriplegic and his brother and parents were killed when their vehicle was broadsided by a drunk driver who ran a stop sign at 50 mph. Plaintiff sued County, alleging dangerous ... condition of intersection. Firm assisted in opposing motion for summary judgment.
