My firm was retained by a lender to handle a complex foreclosure. Among many issues raised was the issue of standing. A dissolved REIT owned by the parent corporation owned the note and mortgage when ... the complaint was filed. No documents were available to show the loan originated by the parent corporation was transferred to the REIT. Likewise, accounting records showing how this was treated in their books were unavailable. The trial took place over a couple of days several months apart.
