You can't study in US on B1/B2 visa. To prove your intent to study in US, you need to have I-20 and then apply for change of status.

What do you mean by 30 day grace period? I don't think it is a legal term under US immigration law. So, I agreed with the previous lawyer.

Your situation is a little confusing to me. You are on OPT and F1 visa but you have already have had an approved I-140 without H1B or other visa....

You should file for immigration visa for her and then she will apply to adjust status. There is no option for a married couple to apply for 10...
