Mar 12, 2012OUTCOME: Order in Favor of the Debtor
A bankruptcy client who grossed over $120,000.00 wanted to file chapter 7 to wipe the slate clean and obtain a "fresh start." We qualified her for chapter 7 based on a controversial provision of the b ... ankruptcy code referred to as "contractually due." The United States Trustee filed a motion to dismiss her case. We took the case to trial and presented oral arguments. Judge Glenn of the Middle District of Florida - Jacksonville Division, ruled in our favor and gave this single mother of 7 the "fresh start" she deserved.
