Defendant refused all plea offers and took his case to trial before a Judge. At trial after the State rested its case, we requested the Court go ahead and find the Defendant not guilty because we felt ...the State had not presented any credible evidence of guilt. The Court agreed and found the Defendant not guilty.

OUTCOME: Continued on probation, declined to finally convict Defendant, and then ordered Defendant to participate in the Supportive Outpatient Program again.
Defendant was on probation, but was having issues with substance abuse. He received deferred adjudication on a state jail felony, so he was not finally convicted, and wanted to avoid being a convicted ...felon. Soon after his probation period started, Defendant voluntarily admitted himself to a short term residential treatment center during probation. When he was released, he continued to have issues and the probation office set up two different outpatient programs for him to attend. The first was a supportive program, but Defendant didn't successfully complete. However, his unsuccessful discharge, he did complete an intensive outpatient program. During that program, Defendant was cited for driving without a suspended license. His probation officer immediately filed a motion to revoke his probation. The prosecutor's only offer was for Defendant to be finally convicted and go to state jail for a year. State jail time is day for day, so Defendant would have been incarcerated for the entire 365 days and he would have become a convicted felon. We rejected the offer and took his case to Court.
