Kevin David Smith

Kevin has been practicing labor and employment law since 2001.  Starting as an associate with an international law firm, Morgan Lewis & Bockius, Kevin then moved on to a national labor and employment law boutique, Ford & Harrison, where he became a partner in 2009.  He took an Of Counsel position at a smaller firm, Meyer White, LLP before starting his own firm, the Law Offices of Kevin D. Smith, P.A. in 2012.  

Kevin is a litigator whose practice focuses on traditional employment claims, including discrimination and retaliation under Title VII and the Florida Civil Rights Act, the ADEA, ADA, FMLA retaliation, Florida whistleblower retaliation, the Fair Credit Reporting Act, the Uniformed Services Employment and Reemployment Rights Act (USERRA), and other employment-related tort and contract claims, including enforcement of non-competition agreements. Kevin has extensive experience with wage and hour actions brought under the Fair Labor Standards Act and the Florida Constitution, including a number of nationwide collective actions. Kevin also has experience in the traditional labor arena through participating in union avoidance programs, representing a nation-wide health care provider during a union organization drive, and representing employers during various employee discharge arbitrations.

Kevin advises clients across the full spectrum of employment issues, from employment agreements and employee handbooks to wage garnishment and covenants not to compete. Kevin focuses on learning his clients’ interests and needs inside and out, which enables him to offer unique, but practical solutions to his clients’ employment problems.

Kevin has been named a “rising star” by Florida’s Super Lawyers in 2009, 2010, 2011, and 2012, and was named “Up-and-Coming Legal Elite” by Florida Trend Magazine in 2007.

Kevin is a member of the State Bar of Florida, the American Bar Association and the Miami-Dade Bar Association. He obtained his J.D. in 2001 from the Georgetown University Law Center and his B.S. in psychology from the University of Florida in 1995. While in law school, Kevin received a distinguished service award for his tutoring and mentoring work with underprivileged children in the D.C. area. He is admitted to the Florida Bar, the United States Court of Appeals for the Eleventh Circuit, and the United States District Courts for the Northern, Middle, and Southern Districts of Florida.

Prior to law school, Kevin worked for three years as a paralegal in the litigation department of Wilmer Cutler & Pickering (now known as Wilmer Cutler Pickering Hale and Dorr) in Washington, D.C., primarily assisting the labor and employment group. Kevin has a wealth of different employment experiences under his belt, ranging from working at McDonald’s, to a summer factory worker with International Envelope, to a salesperson for SunGlass Hut.
