Plaintiff claimed various personal injuries, including traumatic brain injury, as the result of an automobile accident. The Plaintiff was travelling illegally in a turn lane on his motorcycle in order ... to pass stopped traffic when the Defendant properly entered the turn lane without being able to see the approaching motorcycle travelling at a high rate of speed and struck the Plaintiff throwing him from the motorcycle. Plaintiff, who was not wearing a helmet, claimed Defendant was negligent for the accident. As counsel for Defendant, we argued Plaintiff was in violation of a City ordinance by travelling straight, passing traffic in a turn lane. Defendant also argued that Plaintiff's brain injury was the result of his failure to wear a helmet. Plaintiff sought over $2,000,000 in damages. After a complete trial, the jury found Defendant was not negligent.
