Police received an anonymous complaint for narcotics use in the parking lot of an apartment complex. Officers approached the client's vehicle--supposedly to investigate a window tint violation--and dis ... covered heroin and drug paraphernalia on the client's lap. In researching the case law, it became clear that a traffic stop for window tints is illegal if conducted in the parking lot of a gated apartment complex. This was a novel issue of law, which by all indications was never previously litigated. Eric Rudenberg filed a motion to suppress the evidence, based on police officers violating the client's constitutional rights.
