Lawsuit against financial advisor who persuaded elderly widow to loan $150,000 to a third party who never paid her back upon advice from same financial advisor who instructed borrower not to pay back b ... ut, instead, to use the funds to pay for insurance purchased from the same advisor. In 2019, a jury in Omaha, Nebraska held the financial advisor liable for breach of fiduciary duty and fraudulent misrepresentations, on behalf of the estate of the deceased widow. The verdict was affirmed, in April 2020, on appeal to the U.S. Court of Appeals for the Eighth Circuit.

I represented a group of class members who objected to the antitrust class action settlement with diamonds company De Beers for controlling supply and sales and inflating the price of diamonds. Criti ... cal materials for evaluating the $295 million settlement and $75 million lawyer's fees were not made available to absent class members in time to meaningfully review and participate in the final settlement hearing, violating their due process rights. I objected and wrote an appeal to the U.S. Court of Appeals for the Third Circuit to reverse the settlement. In its lengthy opinion, the Third Circuit affirmed the lower court but did not discuss any of my arguments, effectively ducking the issues.
