Nine year old girl mauled by pit bulls in the park next door to her apartment building. The landlord prohibited pit bulls on the premises, but failed to enforce the rule. The landlord also advertised ... the park next door as an amenity of the apartment complex. The trial judge threw out the case against the landlord, who neither owned the dog nor the land where the attack occurred. On appeal, the appellate court overruled the trial judge holding that on these facts, it was a fact question for the jury to decide whether the landlord was liable.
