Unfortunately if the bus driver was not at fault it would be very difficult to recover from the bus company. Keep trying personal injury lawyers...

I agree with Miguel. Name the driver not the insurance or have your insurance fix and have them collect fom other insurance.

The deadline for a cme is dictated by the courts trial order. As long as they ordered the cme by the deadline they are allowed to do so
