I would recommend that you at least consult with an attorney due to the potential for vicarious liability due to Florida's Dangerous...

Yes. He does not have to see you and may well have learned something confidential from your brother leading to his position.

If you have not preserved the evidence the claim will be very hard to prove. Assuming he is now OK, I think it would be better left alone.

I concur with Mr. Goldsmith as well. Your insurance carrier cannot simply abandon you.

I would sue both just to be thorough. Should the evidence show that one was not at fault, they can easily be dropped from the case.
