This action involved five siblings, two of whom challenged their mother's estate plan through will contests and creditor's claims. The two brothers claimed that their mother was not competent to make ... a will and that our client, the personal representative, had unduly influenced her to remove them from her will. After taking their depositions, I was able to negotiate a settlement that ended at litigation among the siblings, allowed for distribution of trust and estate assets and ensured that their mother's wishes were followed, and required one of the brothers to pay the estate's attorneys' fees in defending against his claims.
