My client had been arrested along with the owner of the New England Patriots, Robert Kraft, for soliciting prostitution (allegedly). A motion to suppress evidence was filed to address violation of ... my client’s constitutional right to be free of unreasonable search and seizure pursuant to the 4th and 14th Amendments to the Constitution. Following a hearing, the Indian River County Court granted suppression (exclusion) of the clandestine video footage from inside the massage parlor and issued an Order that the video could not be used at trial. The State of Florida appealed the County Court’s Order of exclusion to the Florida 4th District Court of Appeals. Following oral argument before A panel of three-appellate judges, the 4th District Court of Appeals affirmed (upheld) the exclusionary order barring the State from using the illegally obtained video footage obtained from the arrest.
