OUTCOME: Order of Suppression Affirmed Following Appeal to the State of Florida 4th District Court of Appeal

My client had been arrested along with the owner of the New England Patriots, Robert Kraft, for soliciting prostitution (allegedly). A motion to suppress evidence was filed to address violation of ... my client’s constitutional right to be free of unreasonable search and seizure pursuant to the 4th and 14th Amendments to the Constitution. Following a hearing, the Indian River County Court granted suppression (exclusion) of the clandestine video footage from inside the massage parlor and issued an Order that the video could not be used at trial. The State of Florida appealed the County Court’s Order of exclusion to the Florida 4th District Court of Appeals. Following oral argument before A panel of three-appellate judges, the 4th District Court of Appeals affirmed (upheld) the exclusionary order barring the State from using the illegally obtained video footage obtained from the arrest. Minimal Punishment for Marijuana Possession

OUTCOME: Minimally Restrictive Punishment Following Open Plea to Court

My client was arrested for marijuana possession following a traffic stop. The facts of the case were such that the odor of marijuana was present in the cabin of the vehicle and my client was cooperativ ... e with the arresting officer. Due to these facts, the prosecuting attorney's likelihood of attaining a conviction were extremely high and the client was counseled as to this reality. In light of the State's upper-hand position, negotiations with the prosecutor generated a restrictive plea offer that would have burdened my client's ability to gain employment and would have necessitated agreement to the maximum term of probation allowed by the law for the charge. My client was counseled as to their options and after careful consideration of their position decided that they wished to enter an open plea to the judge and asked that we design a presentation of mitigating facts and circumstances that might persuade the judge that a less onerous sanction was appropriate for this case. At the sentencing hearing, testimony was elicited from the client and his mother that carefully framed his character, his remorse, and his goals in the months immediately following sentencing. After careful consideration of the testimony, the judge imposed a minimal sentence of two months of administrative probation and asked for a follow-up letter prior to the conclusion of the probation so that the judge might be apprised of the client's growth and progress in meeting the near-term goals stated at the sentencing hearing.

OUTCOME: D.U.I. Charges Dropped

Following my client's arrest for d.u.i., the prosecuting attorney provided video footage of the traffic stop. Careful examination of the footage exposed a glaring conflict between the arresting officer ... 's arrest affidavit and my client's behavior at the time of the traffic stop. The officer was carefully cross examined and the contradictions were exposed. Based on the officer's testimony compared to the video footage of the stop and arrest, the judge for this case quashed the arrest for d.u.i. and the State's attorney was forced to nolle prose (drop) the charges .
