You do not have a case against the person who testified because you were not a party to the case. You are better off trying to appeal the case.

It depends on the policy of the particular agency. But theft charges are one of the worst things you can have on your record.

Amend your schedules and file proof of the class. Your lawyer is obligated to do that if he screwed it up.
