ADF International, Inc. v. Suffolk Construction Co., Case No. 2017-026997-CA-01, filed in Miami-Dade Circuit Court
Sep 30, 2019OUTCOME: Final Voluntary Dismissal
Represented Skidmore, Owings & Merrill in a high-value construction dispute arising from the MiamiCentral/Brightline development in downtown Miami. The steel subcontractor, ADF International, sought ap ... proximately $25.8 million in alleged additional compensation, claiming that project planning, design documents, coordination, and site conditions caused increased costs and delay. ADF asserted professional-negligence claims against SOM based on allegations that the architectural and engineering plans and specifications were incomplete, uncoordinated, untimely, nonconstructible, or otherwise below the applicable professional standard of care. ADF further alleged that SOM’s handling of RFIs and design-related issues contributed to added labor, material-handling costs, project disruption, and delay. The defense involved analysis of SOM’s project-specific role, the allocation of responsibility among the owner, general contractor, subcontractor, and design professionals, as well as causation and damages issues arising from complex construction sequencing, change work, site-access limitations, crane logistics, and transit-related coordination. The amended pleading included separate claims connected to the Miami terminal and the adjacent 2 MiamiCentral office project.
