OUTCOME: Verdict then settlement

Claim for non-payment by our client (general contractor, Ledcor) and its subcontractors, stemming from stalled Fauntleroy Place project in West Seattle. Ledcor's claims included breach of contract, li ... en enforcement and violation of Uniform Fraudulent Transfers Act. At first trial, our client (Ledcor) was among the prevailing parties and was awarded a total of $4,444,371.40 plus post-judgment interest. The case settled approximately six months later and the terms of the settlement are confidential.

OUTCOME: Dismissal affirmed by Washington Supreme Court

Consolidated case involved the capacity of limited liability companies to sue or be sued after their certificates of formation are canceled pursuant to provisions in the Washington Limited Liability Co ... mpany Act. Trial court granted summary judgment dismissal of our client, finding that defendant/third-party plaintiff limited liability company did not have right to sue after its certificate of formation was canceled. Both Court of Appeals and Washington Supreme Court affirmed client's dismissal. Case against client was dismissed and opponent was required to pay our client's costs.

OUTCOME: Settlement of $50,000.

Plaintiffs (parents and two minor children) alleged construction defects and personal injuries associated with alleged toxic mold growth - allegedly caused by plumbing leak in crawlspace - in single fa ... mily residence. Plaintiffs sought over $4.0 million in damages collectively. After conducting investigations and consulting nationally recognized experts, defended on theory that localized mold growth posed no significant risk to inhabitants and that alleged personal injuries were not caused by exposure to mold. Settlement contemplated payment of $150,000 to all plaintiffs, of which our client (original plumbing subcontractor) paid $50,000.

OUTCOME: Settlement

Obtained policy limits settlement ($300,000.00) for client, a female plaintiff who was T-boned at an intersection. Injuries included soft tissue (neck and back strain), concussion with memory loss and ... headaches. Prepared case for trial and at-fault driver's insurance companies (and client's insurance company pursuant to under-insured motorist policy) all tendered policy limits one week before trial. The policy limits represented the most money available to the client (i.e., best case scenario result).

The issue in this case was whether an administratively dissolved and cancelled limited liability company (â€œLLCâ€) has standing to prosecute claims. Court of Appeals affirmed trial court dismissal on ... summary judgment. Specifically, Court of Appeals ruled (1) that administratively dissolved and cancelled LLCs are no longer legal entities and have no standing to prosecute a claim; and (2) money paid by a general contractor in settlement with a dissolved and cancelled LLC developer may not serve as the basis of the general contractorâ€™s indemnity claim against its subcontractors.
