The defendant that was responsible, according to the policy report, had only a $50,000.00 insurance policy. Through investigation and accident reconstruction, our office was able to prove that there was another vehicle involved, and the driver of that vehicle had fled the scene. This other defendant had a $250,000.00 policy and the policy was tendered. The total settlement outcome in this case was $300,000.00.

In this case, the defendant was driving a vehicle towards our client in a negligent manner and our client was forced to make an evasive maneuver on his bicycle to avoid the collision. The case did not resolve and the plaintiff was forced into litigation. The insurance carrier argued that our client had a pre-existing and degenerative back condition and that his condition was not related to the accident. In litigation, the defense hired a neurosurgeon to evaluate our client and claim that our client was exaggerating his medical condition and that his condition was not related to the motor-vehicle collision. Our office was able to prove that the defendant was liable and that our client's injuries were related to the incident. The case resolved for the policy limits of $250,000.00.
