OUTCOME: Confidential settlement after successful appeal
The case is reported at 843 So.2d 336 (Florida First District Court of Appeal, 2003)
OUTCOME: Held an Alabama doctor subject to Florida law
My client saw a neurosurgeon in Florida who sent her to a neurologist in Alabama. The Alabama neurologist misdiagnosed her and sent a letter to the Florida doctor who, based on the letter, performed a ... n unnecessary operation and failed to remove the tumor that was the real source of her problems. We sued both doctors. The Alabama doctor contended that he could not be sued in Florida because he never saw the Plaintiff in Florida. We established on appeal that he was subject to Florida law. This is a very important decision. Many doctors now treat patients over the Internet or see them on referral from Florida physicians, and it is critical that they be held accountable in their patients in Florida.
OUTCOME: Jury verdict affirmed on appeal
Automobile struck my client on his motorcycle. The jury put 100% liability on the automobile driver and returned a verdict in excess of insurance policy limits. The Trial Judge granted a new trial bu ... t he was reversed and the verdict affirmed on appeal. The insurance company paid the full amount of the verdict, an amount in excess of policy limits.
OUTCOME: Reversed summary judgment
Client was injured when "safety" glasses allowed a piece of metal to enter his eye. We reversed a summary judgment on strict manufactuer liability for a defective product and the case settled.
