More Transparency and Accurate Information Desired

Had an accident that was pretty much a cut and dry case. Traveling on a highway and was rear ended. The defendant was issued a summons, me (Plaintiff) sustained multiple injuries (spine, shoulder, hand, nose, etc.). Was out on disability for 3+ months. Initial consultation with Zach was encouragi...ng, polite and pretty much laid out providing me with the confidence of hiring him. Soon afterwards, the defendant's insurance company issued a check in the full amount of the defendant's policy - sending it to Zach's office. Zach refused check acceptance at this time as well as the subsequent two (2) other times that the insurance provider had mailed the check. The plan was to obtain the TOTAL cost of medical treatments/rehab and reach a settlement with my insurance provider prior to opening dialogue with the defendant's insurance provider/attorney. At the time that all medical expenses had been finalized, Zach issued a letter to my insurance provider requesting the amount covered in my policy. Within two (2) weeks we had received a response and check for the full amount in the policy. HOWEVER, it was at THIS time that I was informed by Zach that we would NOT be able to pursue the defendant unless my provider decided that it was not in their best interest to do so. This clause is standard in ALL auto insurance policies provided in FL which explicitly states that in such situations when an offer is accepted the insurance provider has the first right of refusal to pursue the defendant. As the smaller hospital bills were coming in, I was paying them. However, amounts over $1000 were left for Zach to "negotiate" down if possible. I had no worries as this had explicitly been discussed during the initial consultation. HOWEVER, I had NOT learned that the largest amount of the outstanding medical bills (approx. 90%) were NOT negotiable due to my current health insurance coverage. Although this was disappointing to learn, it was FRUSTRATING to find this information six (6) months AFTER this could have been resolved and BEFORE some of my medical bills had gone into collections. On top of that, Zach had been pushing me to close out the case prior to the end of the year but I had wanted to wait until some additional defendant information came to light. At the beginning of the year, I contacted Zach to schedule an appointment to discuss wrapping up the case only to find out that he was no longer with the firm AND had already marked my file as CLOSED. Upon speaking with the owner of the firm, he had NO idea why I was calling as he had reviewed the case with Zach prior to his departure and had already filed it away. Needless to say, I was very disappointed with the transparency. Had I NOT hired an attorney, I would have (1)still received the identical amount that was initially offered by both insurance companies; (2) spent $500 MORE in medical bills; and (3) paid all bills on time avoiding collections. As a result of hiring Zach, he (1) reduced my overall medical expenses by approximately $500; (2) caused some medical bills to enter collections; and (3) collected $49,000+ for his firm. CONCLUSION: Money lost/wasted due to lack of transparency & knowledge. This was a simple case and could have been handled much more appropriately - WITHOUT the need of an attorney! It just proved to be an opportunity for easy cash for the attorney.
