N/AOUTCOME: Case dropped
My client was stopped for allegedly running a red light. After speaking with the stopping officer he consented to field sobriety tests. He admittedly did not perform well because he was suffering from ... severe jet lag after a 12 hour flight. Nonetheless he was arrested. He submitted to a breath exam and blew under the legal limit. He gave a urine sample and was concerned about what the results may show. We would not waive speedy trial and demanded the drug results from FDLE. The State failed to file charges within speedy trial. We filed a motion to dismiss wherein the State dropped the case.
