Mark Jay Berkowitz

Mark J. Berkowitz brings more than 35 years of experience as a labor and employment attorney to his work as a mediator. He has represented employees and employers in a wide range of workplace and employment disputes in state and federal courts and before administrative agencies. His practice focused on helping parties resolve complex legal and interpersonal conflicts arising in the employment relationship, often involving sensitive factual circumstances and significant legal exposure. Mark’s experience includes claims involving discrimination, harassment, retaliation, wage and hour disputes, restrictive covenants, employment contracts, severance agreements and employee benefits. He has handled individual and multi-party matters, and he has represented clients in litigation, arbitration and administrative proceedings. In addition to his litigation practice, Mark has appeared before numerous administrative bodies, including the Equal Employment Opportunity Commission, the Florida Commission on Human Relations, the National Labor Relations Board, and the Merit Systems Protection Board. His familiarity with these forums, combined with his trial experience, allows him to assist parties in realistically evaluating risk, understanding the applicable procedural posture, and exploring practical paths to resolution. Mark has also served as an adjunct professor of law at St. Thomas University College of Law, where he taught Alternative Dispute Resolution. He has written and spoken on labor and employment law topics, and he has been active in professional organizations devoted to employment law and dispute resolution.
