Represented a provider in a PIP case against Windhaven Insurance. The insurer failed to pay the claim within 30 days, then tried to deny benefits when the patient did not attend an Examination Under Oa ... th (EUO). We argued that because the insurer was already in breach before the EUO was scheduled, the patient was not obligated to appear. The court agreed, granting our motion and rejecting the insurer’s defense.
