I was charged with 2nd offense subsequent petit theft, but I have never charged a crime before.Why does it say 2nd offense.

It is possible it's a mistake or someone used your identity. You will need to go to your arraignment and ask the judge to appoint a public defender...

Probably can get a diversion under these circmstaces. Supervision time varies up to a year.

Assumes? An assumption wount do it. But if the pot was smelled or had probable cause or consent to search then it's lawful.
