OUTCOME: Confidential Settlement

I defended the CEO/50% shareholder in a $15M+ fraud, breach of contract, misappropriation, trademark infringement, and unfair competition claim brought in 2013 by the Japanese company, Power Support Ja ... pan (“PSJ”), against its US subsidiary, Power Support USA (“PSU”), and my client, involving the distribution and sale of after-market i-Phone products. I also prosecuted various cross-claims on behalf of the CEO against PSJ. After defeating various dispositive motions brought by PSJ, the case settled in February 2014 by selling my client’s 50% share in PSU to PSJ for a confidential amount that was very favorable to my client.

OUTCOME: Settlement

I defended my manufacturer client, Mansfield Plumbing Products, LLC (“MPP”), in this $200M+ class action products liability class action. The Class Plaintiffs sought recovery against Flushmate and var ... ious toilet manufacturers, including MPP. The claim involved allegedly defective Flushmate pressure assisted vessels that had been installed in >2.3M toilet water tanks manufactured and sold from 1997 to 2008. MPP had a 35% market share of that product. In February 2014 Flushmate settled with the class members for an aggregate sum of more than $18M, and as part of the settlement, I convinced Flushmate to reimburse MPP’s defense fees incurred, and Flushmate accepted exclusive responsibility for funding all of the settlement, including any and all of MPP’s financial obligations regarding funding, costs of class notice, claims administration, and plaintiffs' attorney’s fees and costs.
