Halls of Fame, Inc. is a local corporation that submitted bids to operate the Georgia Sports Hall of Fame and the Georgia Music Hall of Fame. The deadline for the Sports Hall of Fame bid was seventeen ... days earlier than the deadline for the Music Hall of Fame bid. During the intervening seventeen days, numerous newspapers filed Open Records Act requests to obtain the Sports Hall of Fame bid proposals. Halls of Fame, Inc. would have been greatly disadvantaged in its subsequent bid for the Georgia Music Hall of Fame if its Sports Hall of Fame bid proposal was released to the press since the proposal included proprietary financial information. As a result, we sought an interlocutory injunction to prevent release of Halls of Fame, Inc.'s Sports Hall of Fame bid until after the deadline for Music Hall of Fame bid proposals.
OUTCOME: Ultimately, the jury awarded the property owner a total of $89,435.00.
The Department contended that the property taken and consequential damages had a value of $63,500, whereas the Condemnee contended that the property taken and consequential damages totaled $256,175.
