OUTCOME: Dismissal of case against Gibson-defendant

I represented Gibson. She brokered a commercial loan for Macias. He was to use about $200,000 to $300,000 to pay off a second trust deed on commercial property. He took the money and spent it. He lost ... the property in foreclosure and then sued Gibson. Gibson filed bankruptcy with another attorney. After struggling with 2 different firms to defend her case, she retained me. I propounded discovery and also filed a motion for judgment on the pleadings. Macias stipulated to a dismissal with prejudice of his state court and bankruptcy court complaints.

I represented Guzman. Guzman entrusted $351,579.05 to Arriaza as part of a 1031 exchange. Arriaza embezzled $341,579.05. Arriaza filed Ch. 7. Guzman sued under sec. 523(a)(2), (a)(4) and (a)(6). Summar ... y judgment for Guzman on sec. 523(a)(4) claim. Remaining claims dismissed at Guzman's request.

OUTCOME: Judgment for Ramseys-defendants

I represented Ramsey. Comm Care sued Mrs. Ramsey in state court. Ramseys filed Ch. 7. Comm Care sued both Mr. and Mrs. Ramsey under sec. 523(a)(2)(A), (a)(4) and (a)(6) for about $50,000.00. After disc ... overy and at the close of Comm Care's case in chief at trial, I made a motion for judgment in favor of Ramsey, as no case was shown against them. Motion granted. judgment for Ramseys and against Comm. care.

I represented plaintiff R. Elwell. She was in her mid-80's. She entrusted $85,000 to her son, N. Elwell. He spent the money in the commodities market, and he never paid it back. He filed Ch. 7 bankrupt ... cy. She sued under section 523(a)(4). After trial, judgment for R. Elwell under section 523(a)(4).
