Defendants appealed from an award of statutory attorney fees in a personal injury action brought pursuant to section 1021.4 of the Code of Civil Procedure.1 They contend that the trial court abused its ... discretion because it awarded plaintiffs attorney fees in the full amount provided for in their contingent fee agreements, without reference to the lodestar method of determining a reasonable award of attorney fees. We agree that the court's failure to apply the lodestar method as its starting point was an abuse of discretion, and will remand for further proceedings.
