What does your lawyer say? That's who should ask.

Illegal? probably not. Can it get you fired and/or sued? Yes.

What should you do? Recommend counseling, kick him out of the house, etc. Your phone, your house, you could be liable.

As a witness you are not his attorney, and cannot act as one. Your role is limited to what you saw on the day in question. He needs an attorney.

He will need an experienced military law attorney to review his entire file and opine on the possibility of getting his DD 214 changed.
