If he said it was Saturday, and it was actually Sunday, Friday, etc, I don't think it makes any difference.

There is no basis for a lawsuit for lack of communication. Lawsuits are expensive and time consuming, and you have no damages to sue for.

Realistically, no. The Terms of Service will limit your ability to sue and, even if it didn't, it will cost way more than $4,000 to hire a lawyer...

How to sue someone is always answered with "by hiring an attorney." It's like asking how to perform surgery. The answer is "by hiring a doctor."
