The IG won't get involved. And the other situation is not relevant. They will send you to TDS. Meet with a defense lawyer and they will help you...

Generally speaking APFT failure leads to an Honorable Discharge.

If you are in the military, you can't sue. Speak to the lawyer handling your discharge case.

Contact your unit and find out what you need to do to complete clearing. Technically you may be AWOL, but they will likely just want to out process...
