I would say it's a close call, which means that the matter is closed. A lawsuit would be a waste of time and money IMO.

I seriously doubt it. You will need an expert to testify that the expired Benadryl caused you to stay in the hospital.

Unless it is a very serious cut with permanent disfiguring, it probably won't be worth the cost but check with a local attorney to confirm.
