IMO, you have nothing to sue for. A lawsuit will cost thousands and take years. This is purely a customer service issue.
If you are a minor, you can't sue anyone. But filming someone who passed out is not grounds for a lawsuit.
One thing to consider is whether she has any money to recover even if you win. But yes, you can sue her.
Any lawsuit requires two things: Negligence and damages. Even assuming negligence, you have no damages to sue for.
You get it dismissed by either paying it off or reaching some agreement with them to do so in which they agree to dismiss it.
I doubt there is anything to do next. Almost being hurt/dying does not lead to a lawsuit. Absent injury, there is nothing to sue for.
