Defendant detox ... center was aware of prior seizure condition and it was a known complication for continued withdrawal. Patient was unsupervised while in detox center and suffered a seizure. Patient hit his head against the wall and then fell to the floor hitting his head again and sustained a traumatic brain injury.

On the 2nd day of ventilator support, a feeding tube was misplaced into the patient's left lung. The feeding tube was supposed to be placed into the patient's stomach. Tube feedings, medicine, and water were administered into the patient's lung over a 5.5 hour period. The patient passed away several days after the misplacement of the feeding tube.
