They can wait up to four years to charge you. Get a lawyer to try and get them to dismiss the case.

If your only violation is a positive drug test you potential exposure is capped at 2 years for a technical violation.

If the case was handled under the pretrial diversion program than expungement might be possible. If you pled guilty then it is not likely.

Yes, for theft to be a felony it has to be more than $1500 in value. That is a lot of fuel.
