CONSTRUCTION LAW
David's construction law practice includes complex litigation matters for clients that range from large owners, such as the State of Georgia and county governments, to smaller contractors and subcontractors. He has handled litigation involving the Georgia World Congress Center, multiple state highway projects, and residential and commercial developments. He assists construction companies in avoiding and minimizing claims, resolving disputes, and closing out problem projects.
With his business, accounting, and tax background, David is uniquely situated to advise clients on ways to maximize their after-tax net income while limiting their liability, particularly through strategically negotiating and drafting construction contracts, structuring transactions, and organizing construction companies. He can advise clients on ways to require contract performance, payment and collection, and documentation of their claims.
ENERGY CONSTRUCTION, PROJECT DEVELOPMENT, AND RENEWABLE ENERGY AND ENERGY EFFICIENCY
David combines his expertise in construction and energy law to advise owners, developers, and utilities in the development of renewable energy generation and energy efficiency projects. For example, David has advised renewable energy developers regarding the availability of governmental incentives, including ARRA Section 1603, the Investment Tax Credit, and the Production Tax Credit. David has assisted in drafting and reviewing renewable power-purchase agreements on behalf of utilities, addressing the allocation of energy tax credits and other tax attributes. David has developed energy-savings-performance contract documents for public bodies.
EDUCATION AND CREDENTIALS
David received his Juris Doctor from Mercer University, Walter F. George School of Law, Macon, Georgia in May 2005. In law school, David received awards for winning the American Association of Attorney-Certified Public Accountants' national essay contest; achieving the highest grade in Partnership Taxation; and the Dean's List. David received his Masters of Science in Accounting from Georgia College and State University. He received his Bachelor of Business Administration in Accounting from Mercer University. He passed the Georgia C.P.A. Exam, scored 93rd percentile on the National ETS Business Exam, and received the Baptist Student Achievement Award and the Kappa Alpha Order Educational Foundation Scholarship. After law school, David worked for Deloitte Tax L.L.P. as an International Tax Consultant for large, multi-national companies.
